Banking and Finance Litigation

Our Litigation Department has extensive experience protecting, securing and enforcing creditors' rights in secured and unsecured transactions. We regularly represent creditors in actions involving loan agreements, security agreements and guarantees. As counsel for corporate trustees, we have commenced litigation to enforce the rights of bondholders under bond instruments. We have also defended corporate trustees against claims for breach of federal law, contract, constructive trust and breach of fiduciary duty. In addition, we have considerable experience defending financial institutions from lender liability claims as well as claims asserted under a variety of state and federal statutes and regulations, including the Federal Truth in Lending Act, Regulation Z, the Federal Real Estate Settlement Procedures Act of 1974, the Homeowners Equity Protection Act, the Federal Fair Debt Collections Practices Act, and New York’s Deceptive Practices Act. We also regularly represent banks in matters arising under the Uniform Commercial Code, including Articles 3, 4 and 9. We also have broad experience representing financial institutions in their capacity as a fiduciary in all courts.
